Warranty Terms
In addition to your statutory rights, AsVIVA Brands GmbH grants the following voluntary warranty on items purchased in its online shop.
Section 1 Relationship to statutory warranty
(1) The following warranty is granted voluntarily and additionally. Your statutory rights – in particular statutory liability for defects (statutory warranty) covering a period of two years – remain completely unaffected by this warranty, are available to you free of charge, and are neither restricted nor excluded.
(2) These warranty conditions exclusively govern the content and prerequisites of the additional, voluntary warranty service. You may assert claims arising from statutory warranty independently of this warranty.
Section 2 Warrantor
The guarantor is AsVIVA Brands GmbH, Borsig Street 4, 41541 Dormagen, Germany (Email: office@asviva.de, Phone: +49 2133 8688812).
Section 3 Subject Matter and Scope of Warranty
(1) The warranty applies to all items purchased in the AsVIVA online shop, including both new items and B-stock or demonstration units.
(2) The warranty extends exclusively to the frame, base structure, and load-bearing metal parts of the product. It is guaranteed that under intended use during the warranty period, these components will not break as a result of a proven material or manufacturing defect.
(3) All other components, functions, surfaces, and features of the product are not covered by the warranty. For these, as well as for all other defects, statutory warranty rights apply exclusively.
Section 4 Warranty Period
(1) The warranty period is 24 months. It begins on the date of purchase (date of invoice or delivery).
(2) If a paid warranty extension was purchased for the product, the warranty period is extended to a total of 36 months; otherwise, Section 7 applies.
(3) The provision of warranty services does not extend the warranty period, nor does it restart it.
Section 5 Scope of Warranty Services
(1) In the event of a warranty claim, AsVIVA will, at its own discretion, repair the affected component free of charge, replace the affected part, or deliver an equivalent replacement product. The choice of the type of warranty service rests solely with AsVIVA.
(2) Replaced parts or devices become the property of AsVIVA.
(3) Further claims – in particular for damages, price reduction, rescission, reimbursement of installation and removal costs, loss of use, or other direct or indirect consequential damages – are not covered by this warranty. Your statutory claims remain unaffected (Section 1).
Section 6 Exclusions from Warranty
Excluded from the warranty in particular are:
- Wear parts and normal wear and tear (e.g., padding, covers, handles and handle covers, running belts and drive belts, cables, bearings, rollers, pedals, coatings, seals, rechargeable batteries and standard batteries, tires);
- Damage caused intentionally, willfully, or negligently, as well as damage caused by force, falling, or transport;
- Damage resulting from improper assembly, commissioning, use, maintenance, care, cleaning, or setup contrary to the supplied operating or assembly instructions;
- Damage caused by overloading, in particular by exceeding the permissible maximum user weight or the permissible load limits, as well as by improper or abusive use;
- Any commercial, profit-oriented, therapeutic, rental, or other use exceeding normal private household use; the warranty applies exclusively to private use;
- Corrosion, rust, or other damage resulting from moisture, outdoor setup, or improper storage;
- Modifications, conversions, repair attempts, or interventions by the customer or by third parties not authorized by AsVIVA, as well as the use of non-original replacement, accessory, or add-on parts;
- Damage caused by force majeure.
§ 7 Optional extended warranty (36 months)
(1) If a paid extended warranty to 36 months has been purchased for the product, AsVIVA will additionally cover the pickup and repair of the device in the event of a warranty claim.
(2) Pickup takes place curbside. The customer must make the device available for handover at the curb or publicly accessible roadside of the delivery address in good time, complete, ready for transport, and sufficiently packaged for safe shipping. Disassembly, packaging, and provision are the responsibility of the customer.
(3) If pickup cannot be carried out for reasons for which the customer is responsible, any additional costs incurred as a result may be invoiced to the customer.
§ 8 Requirements for making a claim
(1) A prerequisite for claiming the warranty is the presentation of the original proof of purchase (invoice) as well as a comprehensible description of the defect; meaningful photos must be provided upon request.
(2) The warranty claim must be reported to AsVIVA immediately upon discovery. The customer must contact AsVIVA before any return or repair; unsolicited returned goods will not be accepted.
(3) The customer is obliged to enable AsVIVA to inspect the claimed device.
§ 9 Territorial scope
The warranty applies to deliveries within Germany.
§ 10 Applicable law
The law of the Federal Republic of Germany applies to the exclusion of the UN Sales Convention (CISG). Mandatory consumer protection regulations of the state in which the customer has their habitual residence remain unaffected.
